PURCHASE GUARANTEE

This contract is written for the protection of the Breeder/Seller, the buyer, and, foremost, the puppy.  To the best of the breeder’s knowledge, the puppy is in good health at the time of the sale.  The Buyer, at the Buyer’s option and expense should have the puppy examined by a veterinarian of the Buyer’s choice within 72 hours of the delivery of the puppy from the Breeder to Buyer, and is urged to do so.  The guarantee will be extended if the 72 hours should elapse on a holiday or Sunday.  However, this guarantee does not cover any health issues caused by neglect or injury.

If a veterinarian examines the puppy and finds it to be “unfit or unhealthy”, they Buyer may return the puppy for a full refund, provided the puppy has not been injured or neglected.  The veterinarian must provide a written statement that the puppy is unfit for purchase.  This must be done in the first 72 hours, no exceptions.

The Breeder reserves the right to have the puppy examined at a veterinarian of the Breeder’s choice for a second opinion.  A veterinarian finding intestinal parasites does not make the puppy unfit for purchase, unless the condition is such that the overall health of the puppy is seriously affected at the time.  Under no circumstances will the Breeder be obligated to pay or reimburse anyone for any vet bills, damages, or any other expenses.

HEALTH GUARANTEE

Should the puppy develop one or more life threatening illnesses or genetic problems within the first year, diagnosed by a veterinarian as precluding the puppy from living an otherwise normal and healthy life as a pet quality animal, the Breeder will be notified in writing within 48 hours of diagnoses and the Buyer shall have the following options:

  1. Keep the puppy, spay/neuter the puppy, and accept a replacement puppy of the same quality as originally purchased.  The replacement will be selected by the Breeder from the next available litter and provided upon proof of the altering procedure and return of the APRI Certificate.  There will be no refund of the

purchase price this is a replacement guarantee only.  Breeders reserve the right to a possible waiting period of six months or more to make this replacement as puppies are not available at all times.  Breeder also reserves the right to request the puppy to be returned, depending upon the circumstances.

  1. Return the puppy to the Breeder along with documentation, veterinarian’s report, and APRI Certificate to accept a replacement as outlined above.

The Breeder is not responsible for any charges incurred in returning or replacing the puppy.  The Breeder is not responsible for any veterinarian charges or fees in diagnosing or treating any illness or genetic disease.  Puppy will not be replaced in any case of neglect, abuse, or accidental death.  If death occurs, an autopsy will be performed at the Buyer’s expense to determine cause of death, the results shall be sent to the Breeder, prior to any replacements.

The Breeder does not guarantee size, color, weight, physical features, or the temperament.  The Breeder also does not guarantee the puppy can be used for breeding purposes or that it is of show quality.

OWNER REQUIREMENTS

The Buyer agrees to:

  1. Give all vaccinations, as recommended by the veterinarian.
  2. Have the puppy checked for internal parasites twice a year.
  3. Place the puppy on heartworm preventative at eight weeks of age.

RETURN POLICY

In the event the Buyer is unable to keep the puppy for any reason, they agree to notify the Breeder immediately at no time shall the puppy be given to a dog pound or shelter.  The Breeder shall have the option of finding a new home for the puppy; however, no refund will be given.  In the event of resale, buyer must notify Breeder and provide the new owner’s name, address, and phone number.

The Buyer agrees that the Breeder may repose the puppy upon evidence of neglect or abuse, at no refund.

The Buyer agrees they are not acting as or in part of an agent in the purchase of this puppy and the Buyer will not sell this puppy to any agent, pet store, or dog business.

The entire agreement between the parties is contained herein.
